Husbands and wives both have the right to work，study，and take part in social and political activities.Both have the right to own，use，and dispose of commonly held property.Each has the right to inherit from the other.Both husband and wife are responsible for the care and support of any children they may have.Either husband or wife may sue for divorce，but the man may not seek a divorce while the wife is pregnant nor within one year after the birth of the child.
Generally divorce rates are low in China.Couples are encouraged to work out their problems with the help of their relatives，friends or neighbourhood residence committee staff，who do everything possible to keep couples from separating.If there is one percent chance of saving a marriage，they expend all their efforts to overcome the 99 percent of difficulty.Divorce will be granted if these efforts at mediation fail.Even in the case of divorce，both parents are responsible for the support of any children.Custody may be given to either parent，depending on which is more suitable under existing circumstances.
